Terms of Service
US, WE, OUR and RSN refers to 'Red Star Network'. YOU, YOUR, THEY, and THEM refers to the client/customer. Red Star Network shall be known throughout this document as RSN.
Acceptance of Contract
The client agrees that by placing an order or signing up for a service to RSN that they agree to the Terms of Service (TOS) and Acceptable Use Policy (AUP).
Payment
Payment is due every month on the same day the first payment is made unless not possible (i.e. if you paid on the 29th, 30th, or 31st of a month, the February payment would be due on the 28th). Payments are due in advance, to cover the forthcoming month of service.
Missed Payment
If payment is not made by the set date, your service will be suspended until paid for. We will hold accounts for 7 days or until a proper explanation is given. A $15 charge may be applied for your account to be un-suspended.
Refunds Policy
RSN does not offer refunds under any circumstance. You may cancel your account at any time before your monthly billing date. If you notify us at least 7 days before the next billing cycle, you will not be billed for the next month. Otherwise, you run the risk of being billed for the next month.
Account Termination
RSN reserves the right to terminate an account at any time without prior warning. This may be due to a breach in the TOS or AUP.
Indemnification
Customer agrees that it shall defend, indemnify, save and hold RSN (or it's employee's/owners) harmless from any and all demands, liabilities, losses, costs and claims, including reasonable legal fees asserted against RSN, its agents, its customers, officers and employees, that may arise or result from any service provided or performed or agreed to be performed or any product sold by customer, it's agents, employees or assigns. Customer agrees to defend, indemnify and hold harmless RSN against liabilities arising out of; (1) any injury to person or property caused by any products sold or otherwise distributed in connection with RSN; (2) any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party and (3) copyright infringement.
Disclaimer
RSN will not be responsible for any damages your business may suffer. RSN makes no warranties of any kind, expressed or implied for services we provide. RSN disclaims any warranty or merchantability or fitness for a particular purpose. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by RSN and its employees. RSN makes no "uptime" guarantees. RSN can accept no responsibility for any loss of data. RSN always advises clients to back up their site data regularly for its own protection.
Finally, RSN wishes to emphasize that in accepting services, customers indemnify RSN for the violation of any law or RSN policy, that results in loss to RSN or the bringing of any claim against RSN. This means that if RSN is sued because of activities of the customer that violate any law, or this policy, the customer will pay any damages awarded against RSN, plus costs and reasonable legal fees.
Failure to comply with any of our terms & conditions will result in grounds for immediate account deactivation. RSN reserves the right to change, edit, or update the policies contained in this document at any time for any reason without notice.
